General Terms and Conditions

1. Definitions:
In these terms and conditions, the following terms have the following meanings: 1.1. "Posh Int" refers to the interior design company Posh Interior, established in Belgium and registered under VAT number BE0761.417.237. 1.2. "Customer" refers to an individual or company that purchases products from Posh Int. 1.3. "Agreement" refers to the agreement between Posh Int and the customer regarding the sale and delivery of products. 1.4. "Products" refers to the goods sold and delivered by Posh Int, including chairs, tables, and other interior design items. 1.5. "Website" refers to the Posh Int webshop, located at www.poshinterior.be. 1.6. "Parties" refers to Posh Int and the customer together. These definitions apply to the Posh Int terms and conditions and are intended to avoid confusion when interpreting the agreement between Posh Int and the customer.

2. Applicability:
2.1 These general terms and conditions apply to all offers, quotations, and agreements from Posh Int regarding the sale and delivery of goods to customers. 2.2 By placing an order with Posh Int, the customer agrees to these general terms and conditions. 2.3 Deviations from these general terms and conditions are only valid if confirmed in writing by Posh Int.

3. Offers and orders:
3.1 All offers and quotations from Posh Int are non-binding and can be revoked at any time, even if they contain a term for acceptance. 3.2 Orders placed by the customer through the Posh Int website are binding. Posh Int reserves the right to refuse orders without stating a reason or to accept them only on the condition that the shipment is made cash on delivery or after prepayment. 3.3 Posh Int is not bound by incorrect price indications on the website or in the webshop and reserves the right to refuse orders if the price is displayed incorrectly. In that case, Posh Int will notify the customer and cancel the order.

4. Delivery:
Delivery costs are the responsibility of the customer, unless otherwise agreed between Posh Int and the customer. Posh Int is not liable for delivery delays due to force majeure, unforeseen circumstances, or any other reason beyond our control. If any problems arise with the delivery, Posh Int will contact the customer to find a solution.

5. Cancellation and returns:
Cancellations are only possible before the order has been shipped. If the order has already been shipped, the customer must refuse the order upon delivery. If the customer wishes to cancel the order after delivery, they must return the products undamaged and are responsible for the return shipping costs. Consumers have 14 days to cancel the order and register the return. You then have 14 days to return the product. If the product is damaged or the packaging is damaged beyond what is necessary to try it out, we may charge you for the reduction in value. Therefore, please treat the product with care and ensure it is properly packaged when returning it. Return shipping costs are the responsibility of the customer, unless otherwise agreed with Posh Int. Upon receipt of the returned products, Posh Int will refund the purchase price as soon as possible, but no later than 14 days after receipt of the returned products.

6. Warranty and complaint handling:
6.1 Posh Int guarantees that the products meet reasonable requirements of soundness and/or usability and the statutory warranty applicable to the products. This means that, in the event of defects in the delivered products, Posh Int will repair or replace the product free of charge. The warranty does not apply if the defect arises as a result of improper or inappropriate use, or if the buyer or third parties have made changes to the product without the written permission of Posh Int. 6.2 Posh Int makes every effort to satisfy its customers. Should a customer nevertheless have a complaint, they can submit it to Posh Int in writing or by email. Posh Int will handle the complaint as quickly as possible, and no later than 14 days after receipt. If the complaint is justified, Posh Int will, at its discretion, replace or repair the delivered products free of charge. If it is not reasonably possible to replace or repair the product, Posh Int will refund the purchase price to the customer. Posh Int will always do its best to resolve complaints satisfactorily and take any improvements into account to continue improving the quality of its products and services.

7. Liability:
Posh Int is not liable for any damage resulting from the use of its products, except in cases of intent or gross negligence on the part of Posh Int. Posh Int is not liable for any indirect damage, including consequential damage, immaterial damage, business interruption, and/or environmental damage. If Posh Int is nevertheless deemed liable for any reason, this liability will never exceed the amount paid in the relevant case under the applicable liability insurance. If no payment is made, Posh Int's liability is limited to the invoice value of the products in question. Posh Int is not liable for product defects caused by normal wear and tear, improper use, or other causes beyond Posh Int's control. Posh Int is not liable for damage caused by using its products contrary to the accompanying instructions. Posh Int is not liable for damage to third parties resulting from the use of its products, unless the damage is caused by intent or gross negligence on the part of Posh Int.

8. Force Majeure:
Posh Int shall not be liable for any delay or failure in the performance of its obligations under this Agreement resulting from causes beyond its reasonable control, including but not limited to acts of governmental authorities, natural disasters, fires, explosions, floods, riots, war, terrorism, strikes, infrastructure failures, or other labor disputes not attributable to Posh Int.

9. Intellectual property:
9.1 All intellectual property rights relating to the products and materials supplied by Posh Int, including but not limited to designs, patents, copyrights, trademarks and trade secrets, remain the property of Posh Int. The customer may only use the products and materials for the purpose for which they were purchased and may not infringe Posh Int's intellectual property rights. 9.2 It is expressly prohibited to copy, reproduce, sell, distribute, modify or use Posh Int's products and materials for commercial purposes without the prior written consent of Posh Int. 9.3 If the customer infringes Posh Int's intellectual property rights, Posh Int will pursue all available legal remedies to protect its rights, including but not limited to claiming damages and obtaining an injunction to stop the infringement.

10. Personal data and privacy:
10.1 Posh Int processes customer personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR). 10.2 Posh Int treats personal data confidentially and uses it solely for processing orders and improving our services. The data will not be shared with third parties unless this is necessary for the execution of the agreement or when we are legally obligated to do so. 10.3 Posh Int takes appropriate technical and organizational measures to protect personal data against loss or unlawful processing.

11. Applicable law and dispute resolution:
11.1 Belgian law applies to all agreements between Posh Int and the customer. 11.2 Disputes between Posh Int and the customer will be submitted to the competent court in the district in which Posh Int is established, unless mandatory law prescribes otherwise. 11.3 If any provision of these terms and conditions proves to be invalid, this will not affect the validity of the remaining provisions. As of February 15, 2016, consumers in the EU can also submit complaints via the European Commission's ODR platform. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not yet being processed elsewhere, you are free to submit it via the European Union platform.
